Your use of Prenetics Limited’s (“Prenetics”) – myDNA Services (the “Services”) is subject to the terms of the legal agreement between you and Prenetics set forth in these Terms of Service (“TOS”). Except as specified herein, these TOS apply to any use of the Services, including but not limited to a) submitting a saliva sample for DNA extraction and processing, b) uploading a digital version of your Genetic Information and interacting with it on the Prenetics website and or mobile application. In order to use the Services, you must first agree to the TOS. You may not use the Services if you do not accept the TOS. You can accept the TOS by (1) clicking to accept or agree to the TOS, where this option is made available to you by Prenetics for any Service; or by (2) actually using the Services. In this case, you acknowledge and agree that Prenetics will treat your use of the Services as acceptance of the TOS from that point onwards.
Prenetics is located at 7/F, Prosperity Millennia Plaza, 663 King’s Road, Quarry Bay, Hong Kong and is referred to herein as Prenetics (or “we,” “us,” “our”).
a. Whether you submit your own saliva sample, a saliva sample for anyone for whom you have legal authority to agree, or otherwise provide your own Genetic Information, you may not use the Services and may not accept the TOS if you are not of legal age to form a binding contract with Prenetics.
b. In addition to the conditions above, if you contribute or otherwise provide your own Genetic Information, you must be eighteen (18) years of age or older to agree to these TOS on behalf of yourself or those for whom you have legal authority to agree.
The Services include access to Prenetics’ myDNA website, mobile application with in-app dietitian access, report phone consultation, and personal genotyping services, including the collection, processing, and analysis of your saliva sample. Each new feature, unless explicitly stated otherwise, that augments or enhances the current Services shall be subject to the Terms of Service. You acknowledge and agree that the Services provided are based on the current state of the art genetic research and technology in use by Prenetics at the time of the purchase or viewing and are provided “AS-IS”. You acknowledge and agree that the Services which Prenetics provides may change from time to time and that Prenetics may stop (permanently or temporarily) providing some Services (or any feature within the Services) to you or to users generally at Prenetics’ sole discretion, without prior notice to you.
As part of our services, we will collect your saliva sample using a DNA collection kit that will be sent to you via courier or provided to you in person. Detailed instructions on how to collect your saliva sample is included in the collection kit.
Genetic Information provides a limited window into your health and fitness. It is only one aspect of your entire health and fitness outlook and should not be assumed to be conclusive. In many cases, the analysis of your Genetic Information is based on correlations between certain genetic markers and different characteristics. Genetic information cannot provide you with conclusive information about the interaction between certain genes and environmental factors, which can significantly change a particular outcome.
You should not change your health behaviors solely on the basis of information from Prenetics. You should always consult with a physician or other health care provider before you make any changes to your diet and lifestyle. Genes are only a small fraction of an individual’s health. There may be unknown genes, environmental factors, or lifestyle choices that are far more important factors.
Prenetics services are for informational and educational use only. We do not provide medical advice. The Genetic Information provided by Prenetics is for informational and educational use only. This means many of the genetic discoveries that we report have not been clinically validated, and the technology we use, which is the same technology used by the research community, to date has not been widely used for clinical testing. As a result of the current state of genetic knowledge and understanding, our Services are for informational and educational purposes only. The Services are not intended to be used by the customer for any diagnostic purpose, nor to predict any disease and are not a substitute for professional medical advice. You should always seek the advice of your physician or other health care provider with any questions you may have regarding diagnosis, cure, treatment, mitigation, or prevention of any disease or other medical condition or impairment or the status of your health.
Any assertions or recommendations in the report as to nutrition, diet or an exercise regimen, whether specific or general, are based on the following assumptions:
1. that you are in a good state of health and do not have any medical problems that you are aware of
2. that you have not had any recurring illness
3. that no healthcare professional has ever advised you not to exercise
4. that you are not on any prescribed medication that may affect your ability to exercise safely or your diet
5. that you do not have any food allergies
6. that if you are female, you are not pregnant and are not nursing
If you have any concerns at any time about whether these assumptions are correct in your circumstances, before acting, or not acting, on any of the assertions or recommendations, you must consult a health care provider.
Prenetics does not endorse, warranty or guarantee the effectiveness of any specific course of action, resources, tests, physician or other health care providers, or other products, procedures, opinions, or other information that may be mentioned on our website or mobile application. If we provide to you on our website any recommendations that identify for you, based on your Genetic and Self-Reported Information and scientific literature or research, potentially actionable information, this information is intended for informational purposes only and for discussion with your physician or other healthcare provider. Prenetics believes that (a) genetics is only part of the picture of any individual’s state of being, (b) the state of the understanding of Genetic Information is rapidly evolving and at any given time we only comprehend part of the picture of the role of genetics, and (c) only a trained physician or other health care provider can assess your current state of health, taking into account many factors, including in some cases your genetics as well as your current symptoms, if any. Reliance on any information provided by Prenetics is solely at your own risk.
By accessing Prenetics Services, you agree to, acknowledge, and represent as follows:
a. You understand that the Prenetics services are intended for informational and educational purposes only. You acknowledge that Prenetics urges you to seek the advice of your physician or other health care provider if you have questions in regards to your overall health.
b. You give permission to Prenetics, its contractors, successors and assignees to perform genotyping services on the DNA extracted from your saliva sample and you specifically request Prenetics to disclose the results of analyses performed on your DNA to you and to others you specifically authorize.
c. You represent that you are eighteen (18) years of age or older if you are providing a saliva sample or accessing your Genetic Information.
d. You are guaranteeing that any sample you provide is your saliva; if you are agreeing to these TOS on behalf of a person for whom you have legal authorization, you are confirming that the sample provided will be the sample of that person.
e. You agree that any saliva sample you provide and all resulting data may be transferred and/or processed outside the country in which you reside.
f. You take responsibility for all possible consequences resulting from your sharing with others access to your Genetic Information and your Self-Reported Information.
g. You understand that all your Personal Information will be stored in Prenetics databases and will be processed in accordance with the Prenetics Privacy Statement.
You agree that you have the authority, under the jurisdiction in which you reside, to provide these representations. In case of breach of any one of these representations Prenetics has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof) and you will defend and indemnify Prenetics and its affiliates against any liability, costs, or damages arising out of the breach of the representation.
In order to use the Services, you must first acknowledge and agree to the Privacy Statement. You may not use the Services if you do not accept the Privacy Statement. You can acknowledge and agree to the Privacy Statement by (1) clicking to accept or agree to the Privacy Statement, where this option is made available to you by Prenetics for any Service; or by (2) actually using the Services.
Prenetics owns and operates our own DNA laboratory with international quality standards and effective protocols in place for handling samples and DNA test processes. The test detects listed alleles and genes with known clinical significance at accuracy of 99.9%, as validated by the Core Facilities-Genome Sequencing Laboratory (CFGSL).
Though Prenetics take the most stringent measures in the industry and preventive measures for sample handling and process, nonetheless, laboratory error can occur, that may affect tests results.
Technical problems may occur despite following best practices. An example of an error that may arise is failure to obtain an interpretable result for a particular SNP. It is sometimes not possible to obtain a testing result for a particular mutation due to circumstances beyond Prenetics’ control, in which case it may not be possible for Prenetics to conclusively report on a genetic change that might be predictive of a condition. As with all medical laboratory testing, there is a small chance that the laboratory could report false positive or false negative results. A false positive result means that a genotype is reported as being present when it is actually not present. A false negative result means that a genotype is not reported as being present when it actually is present.
As a result of some of these errors, Prenetics may need a second sample to complete testing.
This test provides information on how an individual’s genes affect their metabolism, eating behavior, diet and nutritional choices. Tested individuals should not change their diet, physical activity, or any medical treatments they are currently using without consulting their physician or health care provider. Individuals should follow healthy diet and lifestyle as recommended by public health agencies and/or their healthcare provider regardless of whether they have favorable or unfavorable genotypes.
Some individuals may find that their results are not consistent with Prenetics’ selected peer-reviewed scientific research. The association between genetic mutations and the information within this report is an active area of scientific research, and future scientific discoveries might alter our understanding.
